New Earbuds Law for California in 2016.

EarbudsEarbuds or Headsets (SB 491, Transportation Committee): This law, among other things, makes it unlawful to wear a headset covering, earplugs in, or earphones covering, resting on, or inserted in, both ears, while operating a motor vehicle or a bicycle. This prohibition does not apply to persons operating authorized emergency vehicles, construction equipment and refuse or waste equipment while wearing a headset or safety earplugs.
Distracted drivers is a common cause of car crashes. If you are in a car crash and observe that the driver that caused the crash was doing something that distracted them from driving safely, then note it on a piece of paper. Better yet, if the driver is still doing the distracting activity, such as wearing earbuds while driving, take a photo. It may help you prove your case later when you or your attorney is trying to get fair compensation from the insurance company.
