This was a case where the attorneys for the Long Beach Unified School District went out of their way to minimize the traumatic brain injury my client suffered. Our pediatric neurologist, Ronald Gabriel, M.D. who is appointed by the County of Los Angeles as their expert in brain injury cases testified that our client had a traumatic brain injury. Dr. Gabriel relied on the CT scan that showed a subdural hematoma and a bruise on the brain, an abnormal EEG, a brain MRI that showed brain damage and residual hemosiderin (iron left by blood) and neuropsychological tests that showed that my client, who is bright young man, was testing at a severely low level on IQ testing after the skull fracture and brain injury. The jury agreed with us and rejected the arguments of the attorneys for Long Beach Unified School District.
