Advice From An Orange County Car Accident Lawyer
Today many vehicles are equipped with a dash camera recording system or a dash cam can be added for a nominal cost. The return on such an addition to your vehicle can be invaluable. Many of my clients are involved in car crashes that occur at intersections. The collision may involve an issue of who had the right of way. A vehicle turning left has to yield the right of way to vehicles approaching from the opposite direction that are close enough to constitute a hazard at any time during the turning movement, Vehicle Code Section 21801(a). Despite this requirement, many left turning drivers that cause collisions often claim that they had the right of way. They may claim that they began their left turn sufficiently prior to the through vehicle entering the intersection and that the collision is due to excessive speed by the through vehicle. They may also claim that the through driver yielded the right of way and that they were entitled to make their left turn. A dash cam on your side will put these claims to rest.
San Bernardino Car Crash Caught on Video
Recently, one of my clients was traveling eastbound on E. Highland Ave. in San Bernardino, California. He entered on a green light. It was at that time that a westbound driver turned left at the intersection and struck his vehicle head on. My client’s dash cam documented that my client had a green light and the right of way. The dash cam confirmed that the other driver failed to yield, as required to do under the Vehicle Code and turned left, striking my client’s vehicle. Also, the dash cam provided visual evidence of the force of the impact that jolted my client back and forth inside his vehicle, and resulted in multiple parts of his body striking the interior of his vehicle. When the police officer that was investigating the crash was provided the dash cam video, there was no question that the left turning driver was responsible for the collision.
Car Accident Settlement Secured With Dash Cam Footage
Then when it came time to attempt to recover fair and full compensation for my client’s injuries, which were primarily lower back injuries that caused him pain and pain that radiated into his legs, the dash cam again played a significant role. Initially the adjuster for the insurance company did not react that much to the dash cam video. But after I filed a lawsuit and the defense attorney hired by the insurance company saw the dash cam video she knew that the video would be very persuasive to a jury that would be determining the amount of damages that my client would recover for his medical bills, physical pain, mental suffering and emotional distress.
As the dash cam video shows this was a fairly significant collision. There was no question that the other driver was responsible for the collision and the harm that they caused to my client. The dash cam video also provided a visual representation of the forces involved in the crash and those forces were the mechanism that unfortunately caused my client’s injuries. We ended up settling the matter for the defendant driver’s insurance policy limits of $100,000.00.
A dash cam video of a crash may provide additional evidence that assists your attorney with proving that the other driver is responsible and the severity of the crash to you as a person. Property damage photos are useful, but a video literally brings the crash to life and helps an attorney in proving the extent of your damages.
