Dana Point Personal Injury Attorney

Representation for people injured in Dana Point dog bites, falls at the harbor, on the beaches, and at local businesses, crashes on Pacific Coast Highway, and catastrophic injuries.

How the firm helps in Dana Point

Dana Point injuries happen along Pacific Coast Highway, around the harbor, and on the beaches.

Dana Point is a coastal city between Laguna Beach and San Clemente. Pacific Coast Highway runs its length, from Eastline Road at the Laguna Beach line past the harbor to Doheny State Beach and Capistrano Beach, and Crown Valley Parkway, Niguel Road, Street of the Golden Lantern, Del Obispo Street, and Stonehill Drive carry traffic to and from it. The County of Orange leases the harbor to private operators, Doheny State Beach is a state park, and Capistrano Beach Park is run by OC Parks. The claims that follow are dog bites near the beaches and in neighborhoods, falls at harbor shops, restaurants, and hotels, highway and intersection crashes, and injuries serious enough to change a life.

Kyle Scott Law represents Dana Point clients from its office in Tustin, reached by the 5; the firm has no Dana Point office. Every claim starts with a free, confidential review of what happened, who owned or controlled the road or property (the City of Dana Point, the County of Orange, the State of California, a school district, or a private business), which insurance applies, and which deadlines are already running.

01

Dog bites near the beaches and in neighborhoods

California holds a dog’s owner responsible for bite injuries suffered in a public place or while lawfully on private property, whether or not the dog had ever bitten anyone before (Civil Code § 3342). Bites are reported to the Coastal Animal Services Authority; that report, photos of the wounds, and the owner’s insurance information are the starting evidence.

02

Falls at the harbor, on the beaches, and at local businesses

Who answers for a fall depends on who controlled the spot: the County or its harbor operators, State Parks at Doheny State Beach, OC Parks at Capistrano Beach Park, the city for its sidewalks, or a private business. A claim against a public owner generally must be presented within six months (Government Code § 911.2); a fall at a restaurant, shop, or hotel follows the ordinary two-year rule (Code of Civil Procedure § 335.1).

03

Catastrophic injuries that change a life

Some crashes and falls cause brain or spinal cord injuries, amputations, or fractures that need years of care. The claim has to account for future surgery, therapy, home care, and lost earning capacity, and to find every insurance policy that may apply: the vehicle owner’s, an employer’s if the driver was working, umbrella policies, and the injured person’s own underinsured-motorist coverage.

04

Pacific Coast Highway and the streets that feed it

The state relinquished most of Pacific Coast Highway in Dana Point to the city (Streets and Highways Code § 301), so collisions there and on Golden Lantern, Del Obispo, and Stonehill are investigated by Dana Point Police Services, the Orange County Sheriff’s Department team the city contracts with. When an insurer argues the injured person was partly to blame, California’s comparative-fault rule (CACI No. 405) reduces a recovery by that share instead of barring it.

Common questions

Questions from Dana Point clients.

Where would a Dana Point injury case be filed?

In the Orange County Superior Court, which hears civil cases from across the county at the Central Justice Center in Santa Ana; cases designated complex go to the Civil Complex Center. Dana Point’s criminal and traffic cases are filed at the Harbor Justice Center in Newport Beach, including a charge against a driver who caused a crash, but the injury claim is a separate civil case, and many resolve with the insurer before any lawsuit is filed.

A dog bit me in Dana Point. Is the owner responsible?

Often, yes. Under California Civil Code section 3342, a dog’s owner is liable for bite injuries suffered in a public place or while lawfully on private property, even if the dog never bit anyone before. Get medical care, then report the bite to the Coastal Animal Services Authority, which handles animal control for Dana Point and San Clemente (or the Sheriff’s Department after hours). Photograph the wounds, and get the owner’s name, address, and any homeowner’s or renter’s insurance information.

Who investigates a crash on Pacific Coast Highway in Dana Point?

Usually Dana Point Police Services, the Orange County Sheriff’s Department team the city contracts with. The state turned most of Pacific Coast Highway in Dana Point over to the city, so collisions there and on city streets are handled by the Sheriff, and copies of reports come from the Sheriff’s Records unit. Crashes on the 5 are handled by the California Highway Patrol’s Capistrano Area office. Either way, keep the report number you were given at the scene.

I was hurt at Dana Point Harbor or on a beach. Who is responsible?

It depends on exactly where it happened. The County of Orange leases the harbor to private operators and runs some areas through OC Parks, Doheny State Beach is a California state park, and Capistrano Beach Park is an OC Parks beach. A claim against a public owner generally must be presented within six months, so the exact spot and who controlled it are pinned down first.

How long do I have to bring a claim?

Generally two years from the injury to file a lawsuit (Code of Civil Procedure section 335.1). If the City of Dana Point, the County of Orange, the State of California, or the Capistrano Unified School District may be responsible (a city street, a County-run part of the harbor, Doheny State Beach, a campus), a written government claim is generally due within six months (Government Code section 911.2). Claims against a doctor or hospital follow a separate rule with its own time limits (Code of Civil Procedure section 340.5).
