Things To Consider Before Trial

•Conduct surveillance:

–Holidays are optimal for obtaining surveillance that shows activity conflicting with testimony;

–Problem: Pretrial disclosure may be required – most plaintiff attorneys request in discovery;

–Bad or worthless surveillance can damage defendant’s credibility;

–Have to overcome jury’s natural sense of privacy;

–Good surveillance can win a case;

–Discover all of plaintiff’s social media

This is just a portion of The Foundation of the International Association of Defense Counsel’s seminar on how to limit an injured person’s damages at trial. So when you are spending time with your family during the holidays after you have been in an injury incident, the insurance company may have a hired a professional “stalker” to videotape your private family time. They may have someone checking all of your social media pages to find out what you are doing. They will attempt to use your posts about what you are doing in life to “prove” that you are not as injured as you claim. Of course they recommend that their defense attorneys have to overcome the jury’s natural sense of privacy.

This is just some of what you may up against when you are dealing with an insurance company. I recommend that you don’t go it alone. Hire a competent attorney to present your harms and losses that were caused by the other person’s negligence. Do you need an attorney after an injury car crash, slip and fall, dog bite or employment harassment matter? You bet you do!
